With effect from 28 September 2003, for the purposes of new certifications, BCAR Section R is applicable as a requirement only to those aircraft which are excluded from the coverage of Regulation (EC) No. 216/2008. For a definition of these aircraft, see CAP 747, Section 1, Part 2.

In addition, where the European Aviation Safety Agency has accepted an aircraft type on the basis of its UK Type Certificate, and that Type Certificate contains a reference to BCAR R, then for that aircraft type, BCAR R is still applicable as a requirement.

BCAR R may also be used as guidance material at the discretion of the reader. Under such circumstances, it is recommended that the reader consult a CAA Surveyor for advice as to the suitability of application to a specific aircraft or piece of equipment.
